These Terms of Service (“Terms”) govern your use of thebananateam.com and the services provided by The Banana Team LLC, doing business as The Banana Team (“The Banana Team”, “we”, “us”). By using the Services or purchasing a plan, you agree to these Terms.

1. Who we are

The Banana Team is the trading name of The Banana Team LLC, an independent provider of ERP consulting, support, and custom development. We are certified NetSuite developers; we are not an Oracle NetSuite Alliance Partner, Solution Provider, or member of any Oracle partner program, and we are not affiliated with or endorsed by Oracle, Salesforce, or Microsoft. All platform names are trademarks of their respective owners.

2. The Services

We provide support, troubleshooting, scripting, integrations, data migration, implementations, and related consulting, delivered under the plan you select. Deliverables and scope depend on your plan and the hours it includes.

3. Plans, billing, and cancellation

  • Plans are billed monthly in advance through Stripe. Prices are shown on the Plans section and are in US dollars unless stated otherwise.
  • Your subscription renews automatically each month until cancelled.
  • You may cancel at any time; cancellation stops future renewals. See our Refund & Cancellation Policy.
  • Unused hours do not roll over unless your plan states otherwise.
  • We may change prices with reasonable prior notice; changes apply to the next billing cycle.

4. Your responsibilities

  • Provide accurate information and the access we reasonably need to perform the work.
  • Maintain your own backups; you are responsible for your ERP data and third-party accounts.
  • Use the Services lawfully and not to harm others or infringe rights.

5. Intellectual property

Custom scripts and deliverables we create for you become yours upon full payment, except for our pre-existing tools, libraries, and know-how, which remain ours and are licensed to you for use with your systems. Our website content and branding remain our property.

6. Confidentiality

Each party will protect the other’s confidential information and use it only to deliver or use the Services.

7. Warranties and disclaimers

We perform the Services with reasonable skill and care. Except as expressly stated, the Services are provided “as is” without warranties of any kind. We do not guarantee any specific outcome, uptime, or that issues will be fully resolved. See our Disclaimer.

8. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of the Services is limited to the amounts you paid us in the 3 months before the claim. We are not liable for indirect, incidental, or consequential damages, or for loss of data, profits, or business.

9. Termination

Either party may stop the relationship by cancelling the subscription. We may suspend or terminate access for non-payment or breach of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the State or Federal Courts located in Wilmington, Delaware.

11. Changes

We may update these Terms; the “Last updated” date reflects the current version. Continued use after changes means you accept them.
